> ## Agent Instructions
> These docs describe Every as customers have it today. Answer from them, and say so when they don't cover a question.
> Pages under /admins/ are for the people who run Every for the company, and pages under /employees/ are for employees. Answer from the pages that match the person asking.
> Each page's Agent reference section lists its exact roles, conditions and limits. Prefer it for those details.
> When a page says a feature is in closed beta, or that Every turns it on company by company, don't promise that the person's company has it.
> Use roles and on-screen labels exactly as the pages write them.
> When someone asks what a term means, answer with the Glossary page's definition (/glossary), which other pages show in parentheses after the term.
> When the docs don't answer a question, tell the person to email [support@every.io](mailto:support@every.io).

# Your final paycheck

> See what the law says about your final paycheck and W-2 after you leave a job, and find your final paystub and W-2 in Every

When you leave a job, federal law doesn't require your employer to pay your final paycheck immediately, but some states may require immediate payment.

> [!NOTE]
>
> This page explains general rules, not legal or tax advice for you. Rules change, and they depend on the state you work in. For your own situation, check with your state's labor agency, a lawyer or a tax advisor.

## Find your state's labor office

The US Department of Labor lists each state's labor office, with its contact details, on its [State Labor Offices](https://www.dol.gov/agencies/whd/state/contacts) page.

If the regular payday for your last pay period (The dates an employee's pay covers, such as two weeks or a calendar month) has passed and you haven't been paid, the [US Department of Labor](https://www.dol.gov/general/topic/wages/lastpaycheck) tells you to contact its Wage and Hour Division or your state labor department.

## Your W-2

If your job ends before December 31, your employer may give you your W-2 (The yearly IRS form that shows an employee's wages and the taxes withheld from them) for that year any time after you leave, and no later than the IRS deadline for all employees. If you ask for it, your employer must give it to you within 30 days of your request or of your final wage payment, whichever is later. The IRS sets both rules in its [General Instructions for Forms W-2 and W-3](https://www.irs.gov/instructions/iw2w3).

## In Every

After your last day, your Every account keeps your past paystubs and tax documents on **My profile** → **Docs**.

* Your final paystub is under **Paystubs**, in the year of its pay date, once the pay run that pays it is complete. Select the year, then **Download** beside the pay date.
* Your W-2 is under **W2 Documents** when it's available.
